Kentucky Poker Domain Case Thrown Out on Technicality

The Kentucky Supreme Court was unable to rule in favor of online poker and gambling sites in the famous domain grabbing case based on a technicality, it was announced on Thursday.
While groups such as iMEGA and PPA, who represented 141 online sites, were expecting a clean victory over Kentucky Governor Beshear’s efforts to grab their domain names, the court ruled 6-0 that one of the owners of the sites need to appear in court as a plaintiff in order for the case to go forward.
“Although all such arguments may have merit, none can even be considered unless presented by a party with standing,” wrote Justice Mary Noble.
Despite this minor setback, iMEGA and PPA were confident that once the technicality was corrected, they could reapply to the court for a decision to have the latest ruling repealed.
The Chairman of iMEGA, Joe Brennan said that while the group obviously would have preferred a complete victory on Thursday, “it seems this is a technicality that is only delaying the inevitable.”
The group said that it would take immediate action to satisfy the court by getting one of the poker sites’ owners to identify themselves and appear in court.
“The PPA understands the technical nature of the decision issued today by the Kentucky Supreme Court and remains confident that, once that issue is cured, the Supreme Court will address the compelling merits of the arguments in support of the Court of Appeals decision prohibiting the Commonwealth’s seizure of 141 internet gaming sites,” said John Pappas, the Executive Director of the Poker Players Alliance. “There are fundamental freedoms at stake in this case, not only the freedom of poker players in Kentucky and globally, but Internet freedom across the globe.”
“The Commonwealth’s effort at such a bold, broad and, we believe, unlawful seizure sets a dangerous precedent for anyone who uses the Internet,” he added.
